1. Acceptance of Terms
By accessing or using Kin Records, which we refer to as the Service, you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including family administrators, branch administrators, and individual members.
2. Description of Service
Kin Records is a family and clan record-keeping platform that allows users to document family members, relationships, life events, and family history. The Service includes family tree visualization, member profiles, document archiving, and administrative tools for managing family records.
3. Account Registration
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.
4. Subscription and Payments
The Service requires a one-time activation fee of KSh 1,000 and a recurring monthly subscription. Our subscription tiers, which include Starter, Growth, and Large, determine the features and limits available to your family account. Payments are processed in Kenyan Shillings (KSh) through M-Pesa. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.
5. User Content and Data
You retain ownership of all content you upload to the Service, which includes photos, documents, and family records. By using the Service, you grant Kin Records a limited license to store, process, and display your content for the sole purpose of providing the Service. We do not sell, share, or use your family data for advertising or for any purpose other than operating the Service.
6. Acceptable Use
You agree not to use the Service to upload any content that is unlawful, harmful, or offensive. You also agree not to impersonate another person, misrepresent your identity, attempt to gain unauthorized access to other users' accounts or data, or use the Service for any purpose other than legitimate family record-keeping.
7. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy. We are committed to protecting the privacy of your family data and comply with applicable data protection regulations, including the General Data Protection Regulation (GDPR) where it is applicable.
8. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may delete your account at any time through the Settings page. Upon account deletion, we will remove your personal data in accordance with our data retention policy.
9. Limitation of Liability
The Service is provided on an "as is" basis, without warranties of any kind. Kin Records shall not be liable for any indirect, incidental, or consequential damages that may arise from your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the twelve months preceding any claim.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of any significant changes by email or through the Service. Your continued use of the Service after the changes take effect will constitute your acceptance of the updated Terms.
